Bastian Hancock Stynes Lawyers can act and advise in relation to all property related matters, ranging from simple conveyancing and mortgage advice (please see our conveyancing section) to complex disputes between co-owners of property, landlords and tenants, and lenders and borrowers.
If you are a landlord of commercial or retail premises, we can prepare new leases or deeds of renewal and act for you in relation to market rent appraisals and in relation to disputes with tenants, including issuing default notices to non-paying tenants, taking possession of premises if the default is not rectified and pursuing the defaulting tenant for breaching the lease.
If you are a tenant, we can negotiate terms of a new lease for you and act for you in any dispute you may have with your landlord. If you have been served with a default notice for amounts that you dispute, we can assist you in negotiating an outcome, or if necessary, applying for an injunction to prevent your landlord from terminating your lease and by acting for you in subsequent proceedings.
We also act for proprietors of property in disputes with secured lenders, including restraining registration of a disputed mortgage and caveat removal applications.
If you are purchasing or have purchased a home with others, we can prepare or advise on a co-ownership agreement that will govern how the property will be occupied, or in the event that one party wants to sell.
